Applicant must be a natural person at least 21 years old (SDCL 58-22-6; runner: 58-22-12(1)).
Application
Apply in writing on the director's forms and provide requested information and authorizations for the fitness inquiry (SDCL 58-22-14).
Background check
Submit to state and federal fingerprint criminal-background checks and bear the associated costs; failure to submit or cooperate is grounds for denial (SDCL 58-22-14).
Citizenship
United States citizenship is required (SDCL 58-22-6; runner: 58-22-12(2)).
Criminal history
No conviction or guilty/nolo contendere plea to a felony or crime involving moral turpitude. After three years from sentence completion the director may waive the felony restriction for bondspersons; the runner waiver also reaches moral-turpitude crimes (SDCL 58-22-6 and 58-22-12(4)).
Examination prerequisites
The August 2026 handbook lists age 21, one year of South Dakota residence, and an authorization form with payment to the Division of Criminal Investigation. Certified fingerprints are recommended for exam registration; the licensing statute requires fingerprints.
Fees
Submit the $30 licensing application fee (SDCL 58-22-7).
Fingerprints and photo
Provide fingerprints and a recent credential-size full-face photograph. Bondsperson fingerprints must be certified by an authorized law-enforcement officer (SDCL 58-22-7 and 58-22-13).
Historical insurance exemption
SDCL 58-22-5 exempts the holder of a valid all-lines fire and casualty insurance producer licence held before July 1, 1998 from this chapter; this uses an existing licence rather than issuing a separate bail-bond credential.
Ineligible occupations
Jailers, police officers, committing magistrates, magistrate court judges, sheriffs, deputy sheriffs, constables, persons with arrest powers, and persons controlling prisoners are excluded (SDCL 58-22-3).
Insurer appointment
The insurer submits the application and appointment with a $10 appointment fee, and appoints the individual through power of attorney (SDCL 58-22-1(6) and 58-22-8; application page 2).
Out of state activities
SDCL 58-22-51 requires South Dakota bondsperson licensure for bail-bond activities. Out-of-state persons conducting runner activities must notify local law enforcement, present evidence of home-state licensure, and be licensed in their domicile state; this activity permission is not issuance of a South Dakota licence.
Prior disciplinary action
ARSD 20:06:01:04 addresses whether a prior revocation or refusal to renew should bar licensure. The director considers restitution, unresolved complaints, interim employment, time elapsed, and the good-standing factors in 20:06:01:03. This is consideration of a new licence application, not an automatic restoration.
Reexamination
At least one year must intervene after a failed examination before reexamination (SDCL 58-22-18; handbook, Retake Rules).
Residence
A bondsperson must be a bona fide South Dakota resident for the preceding year; a runner must have been a bona fide resident for more than one year last past (SDCL 58-22-6 and 58-22-12(2)).
Renewal of a continuously maintained licence
Active business
Applicant must actively engage in the bail-bond business (SDCL 58-22-6).
Age
Applicant must be a natural person at least 21 years old (SDCL 58-22-6; runner: 58-22-12(1)).
Application
Apply in writing on the director's forms and provide requested information and authorizations for the fitness inquiry (SDCL 58-22-14).
Background check
Submit to state and federal fingerprint criminal-background checks and bear the associated costs; failure to submit or cooperate is grounds for denial (SDCL 58-22-14).
Citizenship
United States citizenship is required (SDCL 58-22-6; runner: 58-22-12(2)).
Continuing education
ARSD 20:06:18:02(6), effective January 28, 2008, exempts a licensee holding a limited licence to sell only bail bonds from sections 20:06:18:01 through 20:06:18:18.
Continuous license
Renewal applies to a continuously maintained licence; other chapter requirements continue. After receipt of the renewal application the current licence remains effective until renewal is issued or denied for cause (SDCL 58-22-20).
Director discretion
SDCL 58-22-20 provides renewal without further examination unless the director deems examination necessary; the exam leaf is retained for that discretion, while ordinary renewal applicants are excused.
Examination prerequisites
The August 2026 handbook lists age 21, one year of South Dakota residence, and an authorization form with payment to the Division of Criminal Investigation. Certified fingerprints are recommended for exam registration; the licensing statute requires fingerprints.
Expiration
Licences expire annually May 1 unless revoked or suspended earlier or the insurer/runner employer cancels authority (SDCL 58-22-19).
Grandfather renewal
SDCL 58-22-5 says renewals of the July 1, 1966 cohort shall be granted subject to 58-22-6, 58-22-19 and 58-22-21; this remains an applicant exemption condition alongside the director's general renewal examination discretion.
Sheriff registration
Register annually October 1 with the sheriff of the residence county; surety bondspersons also file renewed certified insurer powers of attorney (SDCL 58-22-25).
